Written by Estate Planning Attorney Mervin Messias, it highlights the importance of having a Power of Attorney (POA). As our population ages, having this in place cannot be overstated. A POA enables individuals to appoint a trusted person to make decisions on their behalf when they are no longer able to do so.

However, the POA ceases to be effective when the individual loses mental capacity, leaving them vulnerable and without a voice. This book highlights the critical need for POAs to extend beyond the time a person is able to make decisions and advocates for a change in the law to ensure continuity of care.
I recommend laws be amended to allow for enduring POAs to remain effective even when the individual loses mental capacity.
